The term “you” refers to anyone who uses, visits, and/or views the website. REALVALIDITO (“website”, “I”, “we” or “us”) reserves the right to amend or modify these terms and conditions in its sole discretion at any time without notice, and by using the website, you accept those amendments. It is your responsibility to periodically check the website for updates.
Your continued use of the website after posting of any changes to our Terms and Conditions constitutes your acceptance of those changes and updates. If you do not wish to be subject to these terms and conditions, you must not access or use the website.
DESCRIPTION OF SERVICE:
REALVALIDITO hereafter referred to as REALVALIDITO (“REAL VALIDITO” , “real validito” , “Real Validito” , “RealValidito”). Realvalidito.com is a service of REALVALIDITO that provides information on the validity of phone numbers, subject to the terms and conditions below. CUSTOMER warrants that it is the end-user of the data provided by REALVALIDITO and will abide by the terms and conditions set forth herein. The term “CUSTOMER” shall include both free unregistered users and batch/API customers for the purposes of this agreement.
RESTRICTED LICENSE:
CUSTOMER warrants that it is the end-user of the data.
RELIABILITY OF DATA:
REALVALIDITO makes no warranty, expressed or implied, as to the reliability or accuracy of either its service or data provided. Computerized data provided by REALVALIDITO may contain errors, inaccuracies, incompleteness, false “no record” results and omissions. CUSTOMER acknowledges that online data will be used for informational purposes only and shall not be relied on without verification from originating telephone companies. CUSTOMER acknowledges that all data received from REALVALIDITO is in “AS IS” condition and shall be used at the sole risk of the CUSTOMER. CUSTOMER agrees and acknowledges that it shall have no legal or financial recourse against REALVALIDITO, its officers, directors, employees or data-providers for defective, missing, incomplete or otherwise inaccurate data. Outages may occur in REALVALIDITO.COM from time to time for a variety of reasons including but not limited to system maintenance, system crashes, and power outages. CUSTOMER acknowledges that such service outages may occur and agrees that it shall have no legal or financial recourse against REALVALIDITO, its officers, directors, data-providers or web hosting firm as a result. Neither REALVALIDITO, its officers, directors, and employees nor any third party data provider to REALVALIDITO shall be liable to CUSTOMER for any loss or claim arising from customer’s use of REALVALIDITO. If not withstanding the foregoing, if liability can still be assigned to REALVALIDITO, its officers, directors, employees or third-party data providers by an appropriate court of law, or other governing body, then REALVALIDITO’s (and related parties) maximum liability shall never exceed $25.00 regardless of nature, size or scope of claim. Further, CUSTOMER agrees to not seek punitive damages against v, its officers, directors, employees and third-party data providers under any circumstances. Not withstanding the foregoing, if punitive damages can still be assigned to REALVALIDITO, its officers, directors, employees or third-party data providers by an appropriate court of law, or other governing body, then REALVALIDITO’s (and related parties) maximum punitive damages shall never exceed $25.00 regardless of nature, size or scope of claim. CUSTOMER agrees and accepts that REALVALIDITO nor its officers, directors, employees or third-party data providers shall not be held liable to CUSTOMER or any third-parties for any direct, incidental, or indirect claims or damages arising out of customer’s use of service.
MANDATORY ARBITRATION AND GOVERNING LAW:
You expressly waive your right to bring any legal claims, now or in the future, arising out of or related to the website and our products/services. In the event of any dispute, claim or controversy arising out of or relating to your use of this website, the terms and conditions shall be construed in accordance with the rules and regulations of India.
You agree to consent and submit to the jurisdiction of India without regard to the principles of conflict of law or where the parties are located at the time a dispute arises.
You consent to first resolving any disputes or claims through legally required arbitration in India and agree to pay the full cost of arbitration. Your good faith participation in arbitration is a condition precedent to pursuing any other legal or equitable remedies available, such as litigation or any other legal procedure. You also agree that in the event a legal claim is initiated after the required arbitration, the prevailing party shall be entitled to recover reasonable attorney’s fees and other costs associated with the legal action.
INTELLECTUAL PROPERTY:
All content on this website including but not limited to text, logos, marks, graphics, files, materials, services, products, videos, audio, applications, computer code, designs, downloads and all other information here (collectively, the “Content”) is owned by us and other intellectual property and unfair competition laws with the exception of any content from others that we are lawfully permitted to use. You are granted a limited revocable license to print or download Content from the website for your own personal, non-commercial, non-transferrable, informational and educational use only while ensuring it’s not in violation of any copyright, trademark, intellectual property or proprietary rights.
You agree not to copy, duplicate, steal, modify, publish, display, distribute, reproduce, store, transmit, post, create derivative works, reverse engineer, sell, rent or license any part of the Content in any way to anyone without our prior written consent. You agree to abide by the copyright, trademark laws and intellectual property rights and shall be solely responsible for any violations of these terms and conditions.
FAIR CREDIT REPORTING ACT:
As per the FCRA definition, REALVALIDITO is not a consumer reporting agency. Results obtained from this website shall not be used for any decision regarding any FCRA regulated purpose, including employment, housing, insurance or credit.
TELEPHONE CONSUMER PROTECTION ACT:
REALVALIDITO assumes no legal liability for any phone records mistakenly identified as the wrong linetype including under the Telephone Consumer Protection Act and similar Federal and similar State consumer protection laws. We make NO WARRANTY that numbers processed are Do Not Call list compliant — they are not. REALVALIDITO makes no legal representations or offers no legal advice as to what may or may not constitute lawful use of processed telephone numbers.
PRIVACY OF CUSTOMER DATA:
All account information provided by CUSTOMER to REALVALIDITO shall be treated as confidential. REALVALIDITO discloses that customer’s IP address or other identifying information, such as Internet provider name, will be logged and stored as record of customer’s use of service and to identify abuse and fraud.
AUTOMATED SEARCHING:
Automatic scraping or harvesting of data at this site is not permitted. Please note we do not allow this service or data to be re-purposed. If you require this type of processing, we recommend you investigate our batch processing options. We reserve the right to refuse service to any user at any time at our sole discretion.
Terms and Conditions for Payments made to Realvalidito by customer using PayPal
1. General
SEE IMPORTANT DEFINITIONS IN SECTION 2 BELOW.
a. These terms and conditions apply to all PayPal payments made (whether online, by telephone, or in any other manner) to Realvalidito.
b. These terms and conditions also apply to Electronic Communications (whether or not in connection with a PayPal payment).
c. Realvalidito may amend these terms and conditions at any time by posting the amendment on its website at least 30 days prior to the effective date of change.
e. Realvalidito reserves the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice at any time. You agree that Realvalidito, its employees and/or owners, shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
f. You agree that even though you are paying for access, there are still no guarantees or warranties of accuracy. User will (still) assume all risk for any loss or gain resulting from the use of the data, or this site.
g. You agree to the terms and conditions of PayPal agreement and your cardholder agreement, and agree that you will fulfill them.
h. Most importantly – Realvalidito provides the App.realvalidito.com service on an “as-is” and “as-available” basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringment. We make no warranty that the service will meet your requirements, will be uninterrupted, timely, secure, or error-free, or that the results that can be obtained from this site are accurate or reliable, or whether the products or services obtained will meet any standards of quality or usefulness.
2. Definitions
As used in these terms and conditions:
a. “Realvalidito,” “I,” “we,” or “us” refers collectively to Realvalidito., and all of its divisions, subsidiaries and affiliates.
b. “You”, “your” means you, the customer.
c. “Service” means any service provided by Realvalidito, such as Phone Lookup Service to identify “Number Type (Landline or Mobile)”, DNC Lookup Service, Gender Lookup Service and ZIP/Postal Code Lookup Service.
d. “Electronic Communications” means any electronic billing and payment communications sent by Realvalidito to you or by you to Realvalidito, such as online access to statements and emails relating to billing or payment, disclosures, notices and other communications regarding your Service (including, without limitation, your billing statements, notice of the posting of your electronic billing statements, annual privacy notices and change-in terms notifications).
e. Goods / Services purchased are “Realvalidito Lookup Credits” such as (Phone Lookup Credits / DNC Lookup Credits / Gender Lookup Credits / ZIP/Postal Code Lookup Credits) issued to your Realvalidito account for use with Realvalidito provides services
3. Delivery of Goods / Services
a. You acknowledge that purchased goods / Services are considered delivered as soon as the purchased “Realvalidito Lookup Credits” such as (Phone Lookup Credits / DNC Lookup Credits / Gender Lookup Credits / ZIP/Postal Code Lookup Credits) become available in your Realvalidito account
4. Refunds and Realvalidito Lookup Credits Expiry
a. Realvalidito does not issue refunds under any circumstances. All sales are final
b. “Realvalidito Lookup Credits” may have an expiry date associated with their purchase. You acknowledge and agree that expired “Realvalidito Lookup Credits” are forfeit and no extension or refund will be issued for expired “Realvalidito Lookup Credits”
c. This is a Digital service, and you cannot return unused service. No refunds will be issued for any legitimately, intentionally purchased service.
5. Technical Requirements for Electronic Communications
a. In order to make payments online or receive Electronic Communications, you must have access to a personal computer with a modern browser, internet access and a valid email account supported by software that enables you to receive Electronic Communications. In order to store Electronic Communications on paper, you will need a printer connected to your computer. You also may store them in your offline files or in an electronic storage device. Realvalidito is not required to provide paper copies of any Electronic Communication you have previously authorized.
b. You agree to provide us, and keep current, a valid email address. If any Electronic Communication is returned to us as undeliverable, you agree that we may (but are not required to) deliver such communication in paper form to the most recent mailing address you have provided for your account.
c. By authorizing a PayPal payment online, or by requesting Electronic Communications, you confirm that your system meets these requirements, that you have the capability to access and download or print electronic disclosures, and that your email address is current and valid.
6. “Electronic Only” Communications
a. You understand and agree that Realvalidito will provide you with all Electronic Communications exclusively online.
